In accordance with the provisions established in the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter, the “Law”), its Regulations (the “Regulations”) and the Privacy Notice Guidelines (“Privacy Notice Guidelines”) (the “Guidelines”), this Privacy Notice for the Cedros Nature Experiences platform (the “Privacy Notice”) is issued under the following terms:

I.- PERSONAL DATA CONTROLLER

CEDROS NATURE EXPERIENCES, a company in the process of incorporation, with registered address at Calle 19 de Septiembre, Sapo Sector, Pueblo, Isla de Cedros, Baja California, Mexico. CP. 22990, is the entity responsible for the collection, disclosure, storage, use, handling, transfer, and/or disposal of personal data (the "Processing") in accordance with the Law and its Regulations.
 

II.- PERSONAL DATA TO BE COLLECTED

may collect various personal data from members who are granted access to the Platform (any of them, a "Data Subject"), as necessary for the Processing, whether personally and/or directly from the Data Subject, and also indirectly.

a) General identification data: Name, current address (including legal relationship with said address), date and country of birth, tax identification number or similar, applicable tax regime, sex or gender with which the subject identifies, nationality, marital status and languages spoken.

c) Professional or commercial information: occupation, place of work, and information about the Interested Party already known to the Company or provided by the Interested Party to the Company in the course of their employment relationship with the Company.

d) Financial and asset information: Credit or debit cards, CLABE for banking interference or equivalent for making payments through digital platforms.

e) Legal information: Personal data that the Company may be required to collect in accordance with applicable legislation.

f) Other information: product categories or locations that the data subject has visited, products, IP address, date, time and location when the platform is accessed, as well as information provided by the Data Subject during the course of the data subject's use of the platform.

In cases where the Data Subject discloses personal data of third parties to the Company, the Data Subject represents and warrants that he or she is duly authorized by the relevant third party to disclose such personal data and/or that by disclosing such personal data to the Company he or she does not breach any legal and/or contractual provisions.

may collect any other personal data of any nature that: (I) the Interested Party voluntarily provides to us by any means, including electronic or any other means; and/or (II) is contained in supporting documentation provided through printed, electronic or optical means or through any other technology of any nature.

Personal data may be collected:

I. Personally: When the Interested Party provides personal data to become a member of the platform.

II. Directly: When the Data Subject provides their personal data through the platform or by telephone, by email, or by any other printed, electronic, or optical means, or by any other technology of any nature to carry out specific transactions.

III. Indirectly: From any other source of information of the Interested Party as long as it is provided voluntarily.
 

III.- PURPOSES OF THE PROCESSING OF PERSONAL DATA

A) Main or necessary purposes:

The processing of personal data of the data subject collected by or otherwise provided to the Company has the following main or necessary purposes:

I. Create and update a user, profile and character of the data subject on and for the use of the platform

II. Authenticate the interested party when logging into the platform

III. Record of usage preferences and registration information.

IV. Measure the effectiveness of data subject learning and training development.

V. Writing and publishing rankings on the platform

VI. Make inferences about the Data Subject's abilities, interests, and preferences in order to personalize its use and experience based on their particular situation for allied providers and consumers of the general public.

VII. Enforce and monitor compliance with the terms of use of the platform, as well as supervise its correct use

VIII. Protect the rights, property and safety of Cedros Nature Experiences and any other affiliated company, as well as the property rights or safety of the Interested Party or others.

IX. Distribute information and training content on all aspects of reservations and sales team preparation, providing an innovative and engaging training solution.

X. Allow interaction at the end of each training, through quizzes and learning assessments, and obtain badges upon successfully completing certain training rooms.

XI. Provide updates and news on information related to Cedros Nature Experiences

XII. Allow you to browse through different topics related to ecotourism or any other type of outdoor activity.

XIII. Allow users to post comments and interact with colleagues and share content related to Cedros Nature Experiences and the services provided on the platform.

XIV. Direct communications to specific users of the Cedros Nature Experiences platform

B) Secondary or unnecessary purposes:

The processing of the Data Subject's personal data collected by or otherwise provided to the Company has the following secondary or non-essential purposes:

I. Statistical purposes:

In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties, if the Interested Party does not wish their personal data to be processed for any or all of the secondary or non-essential purposes described above, they will have the option to exercise their rights. The Interested Party may express such refusal at any time by sending an email to the following address: Cedrosnatureexperiences@gmail.com with a copy of their identification, in accordance with Chapter V of this notice.

In the event that the Interested Party does not express such refusal, the Interested Party may, at any time, exercise their right to revoke consent and/or object in accordance with this Privacy Notice, the Law and its Regulations.

The right of revocation is highly personal, and therefore may only be made by the interested party with a copy of their identification attached; otherwise, the request will not be deemed valid.

As an option to limit the use and disclosure of the Interested Party's personal data, except through the exercise of the right of access, rectification, cancellation and opposition to the processing of personal data or the right to revoke consent, A
Cedros Nature Experiences informs the Data Subject that they may also register on an exclusion list applicable to the aforementioned secondary or non-essential purposes by sending an email to the following email address: Cedrosnatureexperiences@gmail.com or by written notification delivered to the Company at its address mentioned in this Privacy Notice.

The processing of personal data may also involve purposes that are compatible, analogous, or similar to those mentioned above, without requiring the Data Subject's consent again and subject to the provisions of applicable legal provisions. In any case, the processing of personal data will be carried out to the extent necessary, appropriate, and relevant for the purposes set forth in this Privacy Notice, as well as for any other compatible or similar purposes.

 

IV.- TRANSFERS OF PERSONAL DATA

A) Main and necessary transfers:

CEDROS NATURE EXPERIENCES may carry out the following national and/or international transfers of the Interested Party's personal data as necessary for its processing and, where applicable, for carrying out CEDROS NATURE EXPERIENCES' day-to-day business, maintaining relationships with the subjects and obtaining future clients.

1. To each and every person, worker, employee, collaborator, employer, official, person, entity and/or company that is part of CEDROS NATURE EXPERIENCES or is currently in a professional relationship.

2. To the Company's service providers to fulfill the Company's obligations to the Interested Party.

3. To other third parties for the purpose of enforcing or monitoring compliance with the CEDROS NATURE EXPERIENCES terms of use, as well as the property rights or safety of yourself or others.

4. To the competent authorities that must be aware of the activities between the Interested Party and the Company, in order to comply with the applicable legal provisions and requirements.

All recipients of personal data will assume the same obligations and responsibilities as CEDROS NATURE EXPERIENCES, to the extent and to the extent possible in compliance with Article 37 of the Law.

B) Secondary or unnecessary transfers:

As secondary or non-essential transfers, CEDROS NATURE EXPERIENCES may transfer the subject's personal data to its commercial and business partners for marketing, advertising, offers and promotions for purposes related to the services or products of CEDROS NATURE EXPERIENCES.

If the Data Subject does not wish his or her personal data to be processed for any or all of the secondary or non-essential purposes indicated above, the Data Subject may at any time express such refusal by sending an email to the following email address: Cedrosnatureexperiences@gmail.com

In the event that the Interested Party does not express such refusal, the Interested Party may, at any time, exercise their right to revoke consent and/or object in accordance with this Privacy Notice, the Law and its Regulations.

V.- MEANS AND PROCEDURES FOR THE EXERCISE OF THE RIGHTS OF ACCESS, RECTIFICATION, CANCELLATION AND OPPOSITION TO THE PERSONAL DATA OF THE SUBJECT

In accordance with the Law and subject to any other applicable legislation, the Interested Party may exercise any of their rights of access, rectification, cancellation and opposition to the processing of personal data, for which they must follow the following procedure:

2. Once CEDROS NATURE EXPERIENCES receives the corresponding request, the Interested Party will be sent an acknowledgment of receipt indicating the date of receipt. If the request does not fully comply with all applicable legal requirements and any of the requirements mentioned above, CEDROS NATURE EXPERIENCES may request the Interested Party to complete said missing requirements within a period of five (5) business days from the date of receipt of the corresponding request and the Interested Party will have a period of ten (10) business days from the date on which the Company requests them to complete and correct the pertinent requirements, provided that, if not corrected within the aforementioned period, the request will be considered not submitted to the Company for all legal purposes.

3. If the request is received by CEDROS NATURE EXPERIENCES on a non-business day, the request will be considered received by CEDROS NATURE EXPERIENCES as of the next business day.

4. The Interested Party's request will be attended to via email within a period of twenty (20) business days counted from the date on which the request was duly and correctly submitted to CEDROS NATURE EXPERIENCES in accordance with the preceding paragraphs. The corresponding request may also be attended to through any other public or private means provided for in the documents that make up the relationship between CEDROS NATURE EXPERIENCES and the Interested Party or as may be customary between them. This period may be extended for an additional period of twenty (20) days when justified and notified to the Interested Party in accordance with the provisions of Article 97 of the Regulations.

5. If the Data Subject's request is admissible in accordance with the Law and any other applicable legislation, the Company will carry out the actions related to such request within a period of fifteen (15) business days from the date on which the Company responds to the corresponding request. This period may be extended for an additional period of fifteen (15) days when justified and notified to the Data Subject in accordance with the provisions of Article 97 of the Regulation, it being understood that the Company may refuse to carry out any action related to the relevant request only to the extent permitted by the Law and the Regulation and will then notify the Data Subject through the aforementioned means. In the event that the request is admissible, as established in Articles 32, 33, 34 and 35 of the Law, the delivery of personal data will be free of charge through the email address that the Data Subject provides to the Company and to the extent that it is technically possible to comply with his request. If the Interested Party so requests, or depending on the circumstances of the case, it is deemed necessary to deliver the information by a means other than email, the Interested Party will pay the applicable and justified shipping costs, as well as any other costs arising from copies or other formats generated.

To exercise the right to revoke consent for the processing of the Data Subject's personal data, the Data Subject must follow the same procedures and use the same means established in this Privacy Notice for exercising the rights of access, rectification, erasure, and objection to the processing of personal data, subject to the provisions of applicable legal provisions. It is important for the Data Subject to keep in mind that the Company may not be able to immediately address their request or terminate the use of their personal data, considering that the Company may be required to continue processing their personal data due to a legal or contractual obligation with the Data Subject. Furthermore, the Data Subject will consider that for some purposes, revoking their consent may imply that the Company cannot continue providing the requested service and that, in any case, the admissibility of the Data Subject's request will be subject to applicable legal provisions.

7. If the Interested Party does not express his/her opposition to the purposes of Processing and/or transfers of personal data provided for in this Privacy Notice, in accordance with the procedure established in this Privacy Notice, when such consent is required in accordance with the Law, its Regulations and/or the Guidelines, it shall be understood for all legal purposes that the Interested Party has given his/her consent for such Processing.

Your continued use of the CEDROS NATURE EXPERIENCES platform constitutes acceptance of any amendments to this Privacy Notice, unless otherwise required by applicable law. A data subject's refusal to process personal data for the additional or unnecessary purposes and transfers set forth above shall not be grounds for CEDROS NATURE EXPERIENCES to deny you access to and/or use of the platform.

The right of revocation is highly personal, and may only be made by the interested party; otherwise, the request will not be deemed to have been made.

 

VI.- MODIFICATIONS TO THE PRIVACY NOTICE.

This Privacy Notice may be modified or updated as a result of new legal requirements, CEDROS NATURE EXPERIENCES' own needs and/or privacy practices, changes in its business model, or any other applicable cause in terms of the relevant applicable legal provisions. Any changes to this Privacy Notice will be published on the following website: Cedrosnatureexperiences.com, or notified by email or to the address provided by the Interested Party. Continued use of the CEDROS NATURE EXPERIENCES platform constitutes acceptance of any amendments to this Privacy Notice unless otherwise required by applicable legal provisions.

 

VII.- CONSENT OF DATA SUBJECTS

By using and/or creating an account on the CEDROS NATURE EXPERIENCES platform, the Data Subject declares that they have read and understood this Privacy Notice in its entirety and, therefore, expressly consent to the processing of their personal data for the purposes, including relevant transfers, set forth in this Privacy Notice. If the Data Subject does not object to the processing of their personal data for the secondary or unnecessary purposes and/or transfers set forth in this Privacy Notice, it will be deemed that they have given their consent.

The refusal by the data subject to process personal data for the additional or unnecessary purposes and transfers set forth above shall not be grounds for CEDROS NATURE EXPERIENCES to prevent access to the CEDROS NATUREEXPERIENCES platform. Should the Data Subject wish to exercise any of their rights of access, rectification, erasure, and/or objection to the processing of personal data, limit the use or disclosure thereof, or revoke their consent to the processing, the Data Subject must observe Section "V. Means and Procedures for Exercising the Rights of Access, Rectification, Erasure, and Objection to the Data Subject's Personal Data."
