TERMS AND CONDITIONS FOR RESERVING SERVICES WITH CEDROS NATURE EXPERIENCES.

Thank you for booking with CEDROS NATURE EXPERIENCES.

By clicking the “book” button or reserving by any of the means provided, and making an advance payment for any amount and/or for any concept related to the services provided in favor of CEDROS NATURE EXPERIENCES, as a Client (hereinafter “THE CLIENT”), you or the person you represent is subject to and accepts these terms and conditions, including the cancellation policy, the privacy policy and the data processing that CEDROS NATURE EXPERIENCES carries out through the Cedrosnatureexperiences.com page.

NATURE OF THE SERVICES

By using the CEDROS NATURE EXPERIENCES website or any of the means of communication that CEDROS NATURE EXPERIENCES makes available to the CLIENT, the CLIENT acknowledges and accepts that the services provided by CEDROS NATURE EXPERIENCES include, but are not exclusively limited to, the offer, organization, and provision of ecotourism services and recreational activities provided through third parties with whom CEDROS NATURE EXPERIENCES maintains a commercial relationship for the purposes of providing the service.

CEDROS NATURE EXPERIENCES MISSION

CEDROS NATURE EXPERIENCES aims to facilitate THE CLIENT'S connection with nature by providing ecotourism activity services through CEDROS NATURE EXPERIENCES and third parties, assisting in the publication and promotion of specifically designed expeditions and/or activities, so that these expeditions comprise a fully or partially designed trip. These expeditions and/or activities are carried out in compliance with applicable local and federal legal regulations.

CUSTOMER GUARANTEES

As a condition for requesting a reservation for an expedition, THE CLIENT guarantees that:

You are at least 18 years of age and, if traveling with minors, you have full guardianship over them, being their legal representative in the event of any type of objective civil liability, in a fully joint and several manner for any damage caused in accordance with the Federal Civil Code.

It has the legal authority to create a binding legal obligation.

You will carry out the reservation process in accordance with this Agreement.

We will only use established means of communication to make legitimate reservations for you or another person for whom we have legal authority to represent.

All information provided through you is true, accurate, current and complete.

You have informed or will inform the people traveling with you about these terms, including the risks involved in carrying out the activities you intend to do.

The insurance information you have provided about your coverage is true, reliable, complete, and up-to-date.

By booking an expedition, you agree to pay at that time and to make a payment and eventually all charges to complete the reservation, including the expedition price, applicable fees, offline fees, taxes, and other items identified during the checkout process that are part of the total expedition price published and offered.

Upon receiving confirmation of the expedition, THE CLIENT enters into a contract to receive the services offered. The reservation is a limited license to enter, occupy, and use the accommodations provided by CEDROS NATURE EXPERIENCES or third parties through CEDROS NATURE EXPERIENCES, as well as the amenities and products provided by CEDROS NATURE EXPERIENCES to carry out the activities included in the expedition. These services do not affect the exclusive ownership of these services held by third parties or CEDROS NATURE EXPERIENCES.

CEDROS NATURE EXPERIENCES has every right to demand that the client be removed from the property or land it owns under the terms provided by applicable law, including with the assistance of law enforcement, in the event that THE CLIENT extends their agreed-upon stay. THE CLIENT agrees to hold CEDROS NATURE EXPERIENCES or any of its members harmless from any claim that may arise from THE CLIENT's negligence or recklessness.

THE CLIENT may not arrive with additional people to those who booked the expedition, in which case they grant CEDROS NATURE EXPERIENCES the right to refuse the expedition service to THE CLIENT who brought with them third parties unrelated to the reservation made without the right to any refund.

RESPONSIBILITY

CEDROS NATURE EXPERIENCES is not responsible for any risk or damage suffered by THE CLIENT when receiving expedition services. THE CLIENT is responsible for complying with all instructions and is obligated to act carefully and diligently to avoid any damage upon receiving the shipment and will be responsible for any damage caused intentionally or negligently.

THE CLIENT acknowledges and accepts that many activities carry inherent risks and agrees that, to the extent permitted by applicable law, THE CLIENT assumes all risk arising from its access to visits with CEDROS NATURE EXPERIENCES, including its participation in any expeditions and/or Activities and any other interactions it has with other members, whether in person or online. This means that THE CLIENT is responsible for verifying an expedition to determine if it is suitable for THE CLIENT. For example, the services provided by their nature could carry a risk of illness, bodily injury, disability, or death, and THE CLIENT freely and voluntarily assumes those risks by choosing to participate in the expeditions it books.

THE CLIENT is aware that the activities that may be carried out as part of the services provided by CEDROS NATURE EXPERIENCES are subject to contingent and out of control situations derived from nature itself and its meteorological conditions, which is why CEDROS NATURE EXPERIENCES will not incur any type of responsibility in the event that, due to a situation beyond its control, including but not limited to any case in which the flora, fauna, minerals, relief, aquatic bodies, among others, cannot be seen and/or enjoyed, the activity cannot be provided in its entirety in the manner that was advertised. The foregoing, with the understanding that CEDROS NATURE EXPERIENCES will do everything possible within its power to ensure that said activity can be carried out in the terms that were advertised within the applicable framework of the legislation.

CEDROS NATURE EXPERIENCES has full discretion to determine that activities may not be carried out temporarily or completely due to a potential weather event that prevents them from taking place. In such a case, a way will be found to carry out the activities to the extent possible or that said activity will be replaced by one that allows it to be carried out at that time, with no obligation to reimburse the amounts disbursed by THE CLIENT to CEDROS NATURE EXPERIENCES.

The CLIENT is responsible for confirming that they and anyone under their supervision meet the minimum age, competency, physical condition, or other requirements established to carry out the activities. The CLIENT is responsible for informing CEDROS NATURE EXPERIENCES of any medical, physical, or other condition that may affect their ability to participate, attend, or be part of the expedition offered.

PAYMENT, CANCELLATION AND REFUND POLICY

By making a reservation with an advance payment, THE CLIENT agrees to be legally bound and to make full payment for the expedition so that it is reserved and confirmed. THE CLIENT understands and accepts that the rates and prices offered may be subject to changes determined unilaterally by CEDROS NATURE EXPERIENCES.

CEDROS NATURE EXPERIENCES directly charges, through the payment method selected by THE CLIENT, the amounts corresponding to the total price of the offered expedition and receives the funds as an advance payment in the account designated for that purpose, to organize the expedition. The foregoing, with the understanding that CEDROS NATURE EXPERIENCES carries out payments with third parties for its realization with a certain contingent and independent advance of each trip and that it may change for each CLIENT, which implies that THE CLIENT will not have the right to reimbursement of the entire payment at any time it demands it. As long as the entire agreed consideration is not covered, the amount disbursed will be considered as an advance payment, which must be complemented up to the total price of the agreed consideration at least 7 business days prior to the date of the expedition, under penalty of the expedition being canceled without the right to any refund in favor of THE CLIENT.

To guarantee the reservation, THE CLIENT must cover 50% of the reservation value. If the expedition takes place within a period equal to or greater than 61 days from the reservation date, THE CLIENT will be charged an additional 25% once that date has passed. The remaining 25% will then be charged once there are 60 days left until the expedition. If the reservation is made within a period less than 61 days before the experience, the full amount must be paid to guarantee your spot.

The CLIENT will not be entitled to a refund for cancellation of the expedition at any time, regardless of whether they cancel more or less than 60 days in advance. However, THE CLIENT will have the right to transfer the amount paid to another CEDROS NATURE EXPERIENCES expedition if they cancel more than 60 days in advance. This credit will be valid for 6 months from the date of the trip. If THE CLIENT cancels within 60 days prior to the expedition, the amount paid will not be transferable or refundable under any circumstances.

It is understood that in order to prepare for the expedition, CEDROS NATURE EXPERIENCES must make various arrangements with third parties, including, but not limited to, payments for equipment, tour guides, transportation and food preparation, THE CLIENT will not be entitled to any refund if, due to force majeure, he/she cannot attend the expedition, without any liability for CEDROS NATURE EXPERIENCES, which will comply with the provisions of the corresponding authorities.

If, due to force majeure, THE CLIENT is unable to attend the expedition, THE CLIENT shall have the right to transfer the expedition reservation to a third party up to 24 hours before the expedition. This third party, under their strict responsibility, is not insured under their exclusive responsibility.

Since expeditions require a minimum quota, CEDROS NATURE EXPERIENCES has the right to cancel the expedition if this minimum quota is not met, which implies that THE CLIENT will have the right to receive a full refund, which will be made within a period of no more than 30 calendar days.

THE CUSTOMER will receive the corresponding refund through the selected payment methods or any other methods they may provide to facilitate the refund.

When due to climate change or natural phenomena beyond the control of CEDROS NATURE EXPERIENCES, CEDROS NATURE EXPERIENCES may cancel the expedition, THE CLIENT will have the right to transfer the amount paid to another CEDROS NATURE EXPERIENCES expedition with a validity of 1 year.
THE CLIENT shall have the right to transfer the expedition reservation to a third party. Said third party, under their strict responsibility, is not insured under their exclusive responsibility.

FINANCIAL INFORMATION, INSURANCE AND PAYMENT AUTHORIZATION

The CLIENT acknowledges and accepts that he/she must provide personal and financial information to reserve the expeditions, which will be treated in accordance with the privacy policy of Cedrosnatureexperiences.com.

The CLIENT accepts and acknowledges that it is their sole and exclusive responsibility to provide correct and complete information when registering for the expedition. Therefore, CEDROS NATURE EXPERIENCES will not be liable to the CLIENT or any third parties who may be affected by providing incorrect information to the CLIENT's detriment. If the reservation for the expedition is made less than 20 days in advance, CEDROS NATURE EXPERIENCES cannot guarantee insurance coverage.

THE CLIENT authorizes CEDROS NATURE EXPERIENCES, using the information provided, to make the corresponding charges for the reservation and confirmation of the expedition in national and/or foreign currency to the payment methods provided by THE CLIENT and is not responsible for any loss arising from having provided incorrect information about the payment methods.

CEDROS NATURE EXPERIENCES reserves the right to make effective collections with the payment methods provided by THE CLIENT for damages that THE CLIENT may have caused to the property or equipment of the third party service provider during the reception of services provided, duly justified with evidence from the third party. In this understanding, THE CLIENT will receive a notice of the situation and will have 72 hours to dispute with due evidence its exclusion of the claimed liability or its acceptance and payment of it, with the understanding that, if it does not do so, THE CLIENT grants CEDROS NATURE EXPERIENCES the right to collect the claimed damages so that they can be deposited in the CEDROSNATUREEXPERIENCES account, reserving the right to proceed by exercising corresponding legal actions.

USE OF IMAGE

THE CLIENT, by making a reservation, accepts and grants CEDROS NATURE EXPERIENCES an unlimited license to use any image or video taken and uploaded to the CEDROS NATURE EXPERIENCES platform or social networks under the terms provided in this agreement and the privacy policy of the Cedrosnatureexperiences.com website.
